The Brühl Local Court ordered the defendant not to enter the plaintiffs’ property at T-Weg, ####1 F, without their consent. For each violation, the court warned of a coercive fine of up to EUR 250,000 and, if the fine cannot be collected, coercive detention of up to six months. The defendant was ordered to pay the costs. The judgment was declared provisionally enforceable, with enforcement avoidable by security of 110% of the amount to be enforced unless the plaintiffs first provide security in the same amount.

Tenor

  1. Dem Beklagten wird aufgegeben, es zu unterlassen, ohne Zustimmung der Kläger das Grundstück T-Weg, ####1 F zu betreten.

  2. Dem Beklagten wird angedroht, dass für jeden Fall der Zuwiderhandlung gegen die in Ziffer 1. ausgesprochene Verpflichtung ein Ordnungsgeld bis zu 250.000,00 EUR und für den Fall, dass dieses nicht beigetrieben werden kann, Ordnungshaft bis zu 6 Monaten festgesetzt wird.

  3. Die Kosten des Rechtsstreits werden dem Beklagten auferlegt.

  4. Das Urteil ist vorläufig vollstreckbar.

  5. Der Beklagte kann die Vollstreckung durch Sicherheitsleistung in Höhe von 110 % des zu vollstreckenden Betrages abwenden, wenn nicht zuvor die Kläger Sicherheit in gleicher Höhe leisten.
