The District Court of Brühl partly upheld the plaintiff’s claim against the defendant. Der Beklagte wird verurteilt, an die Klägerin eine Stimmrechtsvollmacht für die Wohnungseigentümerversammlungen und Umlaufbeschlüsse der WEG AStraße, in V, gültig bis zur Eigentumsumschreibung an die Klägerin des dem Beklagten gehörenden hälftigen Miteigentumsanteil von 1/3 aus dem Grundbesitz Gemarkung D, Flur 5, Flurstück 170 verbunden mit dem hälftigen Sondereigentum an der Wohnung im Aufteilungsplan bezeichnet mit der Nummer 1, Grundbuchblatt ## des Amtsgerichts Brühl von D, zu erteilen. Im Übrigen wird die Klage abgewiesen.
Die Kosten des Rechtsstreits trägt der Beklagte.
Das Urteil ist vorläufig vollstreckbar. Der Beklagte kann die Vollstreckung durch Sicherheitsleistung in Höhe von 120 % des aufgrund des Urteils zu vollstreckenden Betrages abwenden, wenn nicht die Klägerin vor der Vollstreckung Sicherheit in Höhe von 120 % des jeweils zu vollstreckenden Betrages leistet.
