Résumé Omnilex

The Kerpen Local Court dismissed the plaintiff's claim against the defendant following a traffic accident. It held that the defendant was not liable under § 142 StGB merely because he abruptly ended a discussion about compensation, where he remained at the scene longer than the other party. The statutory waiting duty no longer applied after the party entitled to obtain findings had left. Nor did the subsequent reporting provision apply where the injured party had departed first in circumstances amounting to a waiver of findings; absent an expressed interest in establishing the facts, the defendant could ordinarily assume such a waiver. Costs were imposed on the plaintiff.

Regeste Omnilex

§ 142 Abs. 1 Nr. 1 und Abs. 2 Nr. 1 und 2 StGB; duties to remain at the scene and subsequently facilitate findings where the other accident participant leaves first. A person who remains at the scene longer than the party entitled to obtain findings is not punishable under § 142 Abs. 1 Nr. 1 StGB merely for abruptly ending a discussion about compensation. Once that party has left, the duty to wait under § 142 Abs. 2 Nr. 1 StGB no longer applies. A systematic interpretation also excludes liability under § 142 Abs. 2 Nr. 2 StGB where the injured party's earlier departure constitutes a waiver of findings. The departing party's lack of any expressed interest in establishing the facts ordinarily permits the other participant to assume such a waiver.

Leitsätze

The defendant was not criminally liable under § 142 StGB on the stated circumstances; the plaintiff's claim was dismissed.

The defendant remained at the accident scene longer than the other party. Once the party entitled to obtain findings had left, no waiting duty remained. Under the systematic interpretation of § 142 StGB, a subsequent reporting offence also did not apply where the injured party had left first, thereby waiving findings; absent an expressed interest in establishing the facts, the defendant could ordinarily assume such a waiver.
