Résumé Omnilex

In a dispute involving legal expenses insurance for a tenant, the court stated that § 4(2) ARB 2002, which excludes coverage for disputes concerning defects in rented property, is insufficiently transparent and unreasonably undermines the policyholder’s rights. After the parties reached a settlement, the Kerpen District Court ordered the defendant to bear the litigation costs, with the settlement costs set off against each other.

Regeste Omnilex

§ 4(2) ARB 2002; exclusion of insurance cover for disputes concerning defects in rented property. A tenant who concludes a legal expenses insurance contract need not accept an exclusion that denies cover for disputes concerning defects in the rented property. Such a clause is insufficiently transparent and unreasonably undermines the policyholder’s rights.
