Résumé Omnilex

An electricity supplier sought an unexplained remaining sum from an electricity bill, as well as reminder and collection costs. The Kerpen Local Court dismissed the claim. It held that the supplier had to explain plausibly how the remaining bill balance was calculated; simply suing for an amount below the original invoice did not let the customer or court verify the balance. The supplier also had to establish that the customer was in default and justify costs proportionate to the arrears, which the account statement suggested may have been only about €60. Costs were imposed on the plaintiff.

Regeste Omnilex

BGB § 433; ZPO § 253; substantiation of an electricity supplier’s balance claim and ancillary collection costs. A claim for an unpaid invoice balance is sufficiently pleaded only if the claimant explains the calculation of the amount still sought. Merely claiming an unexplained partial sum below the invoice total does not permit the defendant or court to verify the alleged debt; such a claim is not adequately specified. Reminder and collection costs require a showing that the customer was in default and that the costs claimed are reasonable in light of the arrears. Permitted tariff amounts under applicable regulations do not dispense with proof of default or proportionality, particularly where the account indicates only a comparatively small outstanding balance.

Leitsätze

A claimant must plausibly explain how the remaining amount is calculated; claiming an unexplained partial amount is insufficient.

Neither the customer nor the court can verify an unexplained balance, and a resulting judgment would not be capable of substantive res judicata.

The supplier had to establish the customer's default and show that the costs were reasonable in view of the amount allegedly overdue.

Permissible tariff amounts alone do not establish entitlement; the record suggested any arrears were only about €60, making proportionality relevant.

The plaintiff bears the costs of the proceedings.

The plaintiff's claim was dismissed.
