Résumé Omnilex

In pending civil proceedings, the Kerpen Local Court suspended the case and referred to the Federal Constitutional Court the question whether § 312a BGB, as applicable until 10 June 2010, is constitutional. The court's headnote identifies a potential equality problem: consumers entering doorstep contracts for instalment delivery may be subject to less favorable cancellation-notice requirements than consumers entering comparable cash transactions. The referral was made under Article 100(1), first sentence, GG, and § 80(1) BVerfGG.

Regeste Omnilex

Art. 3 GG; § 312a BGB in the version applicable until 10 June 2010; the equality principle may be infringed where consumers concluding a doorstep transaction that constitutes an instalment delivery contract are placed at a disadvantage, with respect to the cancellation notice required, compared with consumers concluding a cash transaction. A difference in contractual structure does not by itself justify imposing less favorable consumer-protection requirements on the instalment-contract consumer. The court therefore referred the question of the provision’s constitutionality to the Federal Constitutional Court under Art. 100(1), first sentence, GG.
