Résumé Omnilex

The plaintiff's package-travel claim was based on the outbound flight being advanced by five hours, turbulence during the flight, and the view of a construction site about 300 metres away. The Local Court of Bonn dismissed the claim. It held that the five-hour flight change was not a defect, that turbulence did not establish a defect absent physical impairment, and that merely seeing a construction site at that distance was not a defect in a package-tour area. The plaintiff was ordered to bear the costs. The judgment was declared provisionally enforceable, subject to the stated security conditions.

Regeste Omnilex

BGB §§ 651a, 651c and 651d; package-travel defect. Advancing the outbound flight by five hours does not, by itself, constitute a defect in a package flight trip. Turbulence during air transport is not a travel defect where it causes no physical impairment to the travellers. Nor does the mere sight of a construction site approximately 300 metres away constitute a defect, at least in package-tour areas. The assessment turns on whether the circumstances amount to a shortcoming in the travel services provided; the stated circumstances do not suffice.
