Résumé Omnilex

The plaintiff sued a contractor over damage associated with a glow plug that broke and fell into an engine. The court held that a contractor who culpably breaches its care duties under a work contract is liable in damages, with the contractor bearing the burden of proving absence of fault. The plaintiff's disposal of the broken plug was not destruction of evidence: parties generally owe no duty to preserve evidence for an opponent, and a layperson could not be expected to know the fragment might reveal the cause of the break. The court ordered the defendant to pay €1,997.57 plus interest from 18 May 2004, dismissed the remainder, and allocated costs 20% to the plaintiff and 80% to the defendant.

Regeste Omnilex

BGB §§ 280(1), 631, 634 no. 4; contractor's liability for breach of care duties under a work contract and destruction of evidence. A contractor is liable for damages where it culpably breaches contractual care duties; the contractor bears the burden of proving that it was not at fault, and doubts operate against it. Parties are generally not subject to a duty to preserve evidence for the benefit of their opponent. Destruction of evidence requires that the party recognize, or negligently fail to recognize, the need for later proof and thereby frustrate it. A layperson need not foresee that the lower portion alone of a broken glow plug may disclose the cause of its fracture.

Normen: BGB §§ 280 I, 631, 634 Nr. 4

Leitsätze
