Die Beklagte wird verurteilt, an den Kläger 2.500,- Euro nebst Zinsen in Höhe von 8 %-Punkten über dem Basiszinssatz seit dem 03.06.2009 zu zahlen.
Die Beklagte wird weiter verurteilt, den Kläger von der Forderung seines
Bevollmächtigten über vorgerichtliche Rechtsanwaltskosten in Höhe von 229,30 Euro freizustellen.
Im Übrigen wird die Klage abgewiesen.
Die Beklagte hat die Kosten des Rechtsstreits zu tragen.
Das Urteil ist gegen Sicherheitsleistungen in Höhe von 10% über dem jeweils vollstreckbaren Betrag vorläufig vollstreckbar.
