Tenor

Der Beklagte wird verurteilt, an den Kläger 238,00 Euro nebst Zinsen hieraus in Höhe von 8 Prozentpunkten über dem jeweiligen Basiszinssatz seit dem 04.05.2009 zu zahlen.

Die Kosten des Rechtsstreits werden dem Beklagten auferlegt.

Das Urteil ist vorläufig vollstreckbar.
