Tenor

  1. Die Beklagte wird verurteilt, an die Klägerin 50,- € nebst Zinsen in Höhe von 5 Prozentpunkten über dem Basiszinssatz des § 247 BGB seit dem 10.06.2010 zu zahlen. Die Beklagte wird weiter verurteilt, an die Klägerin vorgerichtliche Anwaltskosten in Höhe von 46,41 € nebst Zinsen in Höhe von 5 Prozentpunkten über dem Basiszinssatz des § 247 BGB seit 30.07.2010 zu zahlen. Im Übrigen wird die Klage abgewiesen.

  2. Von den Kosten des Rechtsstreits tragen die Klägerin 73 % und die Beklagte 27 %.

  3. Das Urteil ist vorläufig vollstreckbar.
