The plaintiff brought a claim against two defendants. Die Beklagten werden als Gesamtschuldner verurteilt, an den Kläger 361,82 EUR nebst Zinsen in Höhe von fünf Prozentpunkten über dem Basiszinssatz seit dem 28.05.2010 zu zahlen.
Der Beklagte zu 1) wird weiter verurteilt, an den Kläger auf einen Betrag von 361,82 EUR Zinsen in Höhe von fünf Prozentpunkten über dem Basiszinssatz vom 26.05.2010 bis zum 27.05.2010 zu zahlen.
Die Beklagten zu 1) und 2) werden weiter als Gesamtschuldner verurteilt, den Kläger von vorgerichtlichen Rechtsanwaltskosten der Rechtsanwälte I, Q, M & Collegen in Höhe von 30, 94 EUR freizustellen.
Im Übrigen wird die Klage abgewiesen.
Die Kosten des Rechtsstreits tragen der Kläger zu 88 % und die Beklagten zu 12 %.
Das Urteil ist vorläufig vollstreckbar. Die Parteien können die jeweils gegen sie gerichtete Vollstreckung durch Sicherheitsleistung in Höhe von 110% des aufgrund des Urteils vollstreckbaren Betrages abwenden, wenn nicht der jeweilige Vollstreckungsgläubiger vor der Vollstreckung Sicherheit in Höhe von 110% des jeweils zu vollstreckenden Betrages leistet.
