Résumé Omnilex

The Bonn District Court dismissed the plaintiff’s action in an insurance dispute. It held that § 5a VVG (old version) was compatible with European Community law and that, where the required policy documents were sent after contract conclusion, the withdrawal period began upon their delivery. It also stated that damages for negligent advice were subject to the five-year limitation period under § 12(1) VVG (old version), running from the end of the year in which the benefit could be demanded. The plaintiff was ordered to bear the costs.

Regeste Omnilex

§ 5a(2), fourth sentence, VVG (old version); compatibility with European Community law and commencement of the withdrawal period; § 12(1) VVG (old version); limitation of damages claims for negligent advice. The statutory withdrawal regime does not contravene European Community law. If the documents required under § 10a VAG are provided to the policyholder only after the contract has been concluded, the withdrawal period under § 5a VVG (old version) begins upon their subsequent transmission. A claim for damages arising from negligent advice is subject to the five-year limitation period in § 12(1) VVG (old version), calculated from the end of the year in which the benefit may be demanded.
