Résumé Omnilex

The District Court of Bonn ordered the defendant to stop continuing disturbances and noise in her home, including banging on shared walls and loud disorderly conduct by her disabled daughter, whom she cared for. The court recognized that neighbors must show heightened tolerance in view of the constitutionally protected interest in enabling disabled people to live with as few avoidable restrictions as possible. That tolerance does not prevent an injunction where the disturbances are no longer acceptable even after due consideration of the disabled person’s interests and treatment options have not been fully exhausted. A person who has factually assumed care may be liable as a disturber without being the person’s legal guardian. The defendant was also ordered to pay costs.

Regeste Omnilex

BGB Art. 906 and 1004; ZPO Art. 253 para. 2 no. 2; neighborly tolerance toward noise associated with disability; liability of a de facto caregiver. The constitutionally protected objective of enabling persons with disabilities to live free from avoidable restrictions requires heightened tolerance in neighborly relations. That duty is not unlimited: an injunction may be granted where noise disturbances, assessed in the individual case and with due regard to the legitimate interests of disabled persons, are no longer reasonably tolerable and available treatment options have not been fully used. A person may be treated as a disturber and enjoined from causing or permitting the disturbance despite not being the affected person’s legal guardian, if that person has in fact assumed care.

The defendant must stop the continuing disturbances; the interests of disabled people do not require neighbors to tolerate noise that is unreasonable in the circumstances when treatment options have not been fully exhausted.

Neighborly relations require heightened tolerance toward the concerns of disabled people, but that does not bar injunctive relief where the disturbances are no longer tolerable even after considering those interests. A person who has in fact assumed care may be liable as a disturber even without being the legal guardian.

The defendant must bear the costs of the proceedings.
