Résumé Omnilex

The plaintiff sued the defendant bank after paying for a used camera purchased on eBay into an account opened at the bank under a false name using forged identification. The camera was not delivered. The court rejected the plaintiff's claims against the bank, including claims in damages and restitution, holding that the account holder's fraud did not give rise to such claims against the account-holding institution. It also found that the bank did not act contrary to public morals by obtaining a garnishment and transfer order to secure claims arising from the account holder's crimes, even though the account holder could not be identified. The plaintiff was ordered to bear the costs.

Regeste Omnilex

BGB §§ 280 Abs. 1, 812 Abs. 1 S. 2, 823 Abs. 1 and 2, 826; payment to an account designated by an online seller and the bank's subsequent enforcement measures. A buyer who transfers the purchase price to the account specified by the seller does not, merely because the seller fails to deliver and opened the account under a false identity supported by forged identification, acquire a damages or restitution claim against the account-holding bank. The account holder's fraud does not by itself establish a claim against the bank under the cited provisions. Nor does a bank act contrary to public morals toward the defrauded buyer by obtaining a garnishment and transfer order to secure claims arising from the account holder's criminal conduct, even where the false identity prevents the account holder from being identified.

The plaintiff has no damages or restitution claim against the account-holding bank for the seller's failure to deliver the camera.

The payment was made to the account specified by the seller. The account holder's use of a false name and forged identification did not establish a damages or restitution claim against the bank.

The bank's procurement of the garnishment and transfer order was not contrary to public morals toward the plaintiff.

The inability to identify the account holder because of false information did not make the bank's action to secure claims arising from the account holder's crimes immoral toward the plaintiff.

The plaintiff must bear the costs of the proceedings.
