Résumé Omnilex

The landlord obtained an order requiring the tenant to vacate and return a three-room apartment and a basement room. The court held that severe odor nuisance emanating from a tenant’s apartment can justify at least ordinary termination of the tenancy under BGB § 573(2)(1). The tenant was ordered to bear the proceedings’ costs. The court granted a 12-month period to vacate and made the judgment provisionally enforceable, allowing the tenant to avert enforcement by providing security of €5,000, unless the landlord provides security in the same amount.

Regeste Omnilex

BGB § 573(2)(1); severe odor nuisance as a ground for termination of a tenancy. Serious odors emanating from a tenant’s apartment and materially disturbing others may constitute a legitimate interest in terminating the tenancy. Such circumstances can justify at least ordinary termination, even where immediate termination is not at issue.
