The plaintiff sought relief based on an assignment of a numerically specified portion of claims arising from a traffic accident. The Bonn Local Court held that, where an accident gives rise to multiple claims, a portion defined only by a monetary sum cannot be assigned from their aggregate total. The court dismissed the claim and ordered the plaintiff to bear the costs. The judgment was declared provisionally enforceable, subject to security, and leave to appeal was granted.
BGB Art. 398; assignment of claims arising from a traffic accident: If an injured party has several claims resulting from one accident, a part of their aggregate monetary value cannot be assigned by specifying only a sum. The assigned claim must be sufficiently identifiable; a bare numerical fraction of the total does not determine which individual claim, or what part of which claim, is transferred.

Entstehen aus einem Verkehrsunfall für den Geschädigten mehrere Forderungen, so kann von der Gesamtsumme der Forderungen nicht ein nur summenmäßig bestimmter Teil abgetreten werden.
Die Klage wird abgewiesen.
Die Kosten des Rechtsstreits trägt die Klägerin.
Das Urteil ist vorläufig vollstreckbar. Die Klägerin kann die Zwangsvollstreckung gegen Sicherheitsleistung in Höhe von 120 % des auf Grund des Urteils vollstreckbaren Betrages abwenden, wenn nicht die Beklagte vor der Zwangsvollstreckung Sicherheit in Höhe von 120 % des jeweils zu vollstreckenden Betrages leistet.
Die Berufung wird zugelassen.
