The applicant challenged the Federal Cartel Office’s decision of 2 April 2013 concerning access to the file in cartel administrative-offence proceedings. The Bonn District Court rejected the challenge as unfounded. It held that, after the proceedings have been discontinued, there is no right to inspect the file under § 147 StPO in conjunction with § 46 OWiG. The applicant was ordered to bear the costs.
§ 147 StPO in conjunction with § 46 OWiG; access to files after discontinuance of cartel administrative-offence proceedings. Once such proceedings have been discontinued, the special right of access to files under § 147 StPO, applied through § 46 OWiG, is no longer available. A request for access after discontinuance therefore cannot be granted on that basis.
