The plaintiff's claim against the defendant was dismissed. The court held that a travel organizer need not inform customers about circumstances affecting the validity of their own passports. It also ruled that a travel agency's agreement to help complete an ESTA form for travel to the United States does not, absent an additional agreement, include a duty to check the customer's passport validity. Die Klage wird abgewiesen.
Die Kosten des Rechtsstreits werden der klagenden Partei auferlegt.
Dieses Urteil ist vorläufig vollstreckbar.
Dem Kläger hat das Gericht gestattet, die Zwangsvollstreckung gegen Sicherheitsleistung in Höhe von 110 % des vollstreckbaren Betrages abzuwenden, wenn nicht die Beklagte vor der Zwangsvollstreckung Sicherheit in Höhe von 110 % des zu vollstreckenden Betrages leistet.
