In a civil action arising from a traffic accident, the plaintiff sought compensation including the cost of a replacement vehicle. The Bonn Local Court awarded €568.48, together with interest at five percentage points above the base rate from 15 January 2016, and €101.40 in extrajudicial attorney fees with the same interest. The remainder of the claim was dismissed. The court allocated 19% of the litigation costs to the plaintiff and 81% to the defendant. It held that ordinary-rate replacement-car rental costs may be estimated under § 287 ZPO by taking the arithmetic mean of the Schwacke and Fraunhofer lists for the rental company's postal-code area.

Der Geschädigte eines Verkehrsunfalls hat bei Anmietung eines Ersatzfahrzeuges Anspruch auf Ersatz der Mietwagenkosten in Höhe des Normaltarifs. Dieser kann nach § 287 ZPO geschätzt werden unter Berechnung des arithmetischen Mittels zwischen der Schwacke-Liste und der Liste des Fraunhofer Instituts in dem Postleitzahlgebiet des Vermieters.
Der Beklagte wird verurteilt, an die Klägerin 568,48 € nebst 5 Prozentpunkten Zinsen über dem Basiszins seit dem 15.01.2016 sowie außergerichtliche Anwaltsgebühren von 101,40 € nebst 5 Prozentpunkten Zinsen über dem Basiszins seit dem 15.01.2016 zu zahlen.
Die darüber hinausgehende Klage wird abgewiesen.
Von den Kosten des Rechtsstreits tragen die Klägerin 19 % und der Beklagte 81 %.
Das Urteil ist vorläufig vollstreckbar.

Recoverable rental costs may be assessed using the ordinary-rate tariff estimated under § 287 ZPO by averaging the Schwacke and Fraunhofer lists for the rental company's postal-code area.
The court applied this estimation method to determine the recoverable amount and granted the claim in part.
