Résumé Omnilex

The applicant sought legal aid for advice about C.'s estate, including whether she was an heir or a legatee and how a later will should be interpreted alongside an earlier one. The court found the reminder against the clerk's refusal well-founded. Although information from public authorities can generally be an alternative source of advice, these inheritance questions were unusually complex. Given the applicant's limited education and circumstances, she could not be expected to formulate effective inquiries herself. A certificate-of-inheritance application would not determine whether a legacy existed. The refusal was set aside and legal aid granted; out-of-court expenses were not reimbursed.

Regeste Omnilex

§ 1 No. 2 BerHG; availability of another source of advice in complex inheritance matters. The possibility of obtaining legal information from a competent authority generally constitutes another counseling option. It does not do so where the legal questions are unusually difficult and the applicant, considering their personal education and circumstances, cannot reasonably be expected to formulate the necessary requests for information. A certificate-of-inheritance proceeding is not an adequate substitute if it would determine heirship but leave unresolved whether a legacy exists. The assessment of alternative advice must therefore account both for the substantive scope of the proposed alternative procedure and the applicant's practical ability to use it.

Spruchkörper: 52. Abteilung des Amtsgerichts

Normen: §§ 11, 24 a RpflG, § 6 Abs. 2 BerhG, § 1 Nr. 2 BerhG

Tenor

The applicant qualified because the inheritance issues were legally complex and she could not reasonably formulate the necessary inquiries herself.

The distinction between heirship and a legacy, and the possible supplementary interpretation of a later will by reference to an earlier one, required legal expertise. The applicant lacked higher education and would have been unable to frame appropriate requests; an application for a certificate of inheritance would not resolve whether a legacy existed.

Out-of-court expenses are not reimbursed.
