Résumé Omnilex

The applicant sought advisory assistance for negotiating an enforcement agreement relating to a judgment-based loan debt. A court registrar had denied the request. The applicant’s account had been blocked by a garnishment order despite receiving her monthly salary from ARGE, leaving her effectively without funds. Her bank could not resolve the matter and referred her to a lawyer. The Bochum Local Court allowed her reminder, set aside the registrar’s decision, and granted advisory assistance, finding that consulting a lawyer was not unreasonable in these circumstances. It ordered that extrajudicial expenses would not be reimbursed.

Regeste Omnilex

§ 6 Abs. 2 BerHG; the assessment whether obtaining legal assistance is unreasonable must take account of the applicant’s concrete circumstances. Where a blocked account leaves an applicant effectively without funds and the bank cannot assist but refers the applicant to a lawyer, seeking counsel to negotiate an enforcement agreement is not unreasonable. The availability of a lawyer’s assistance may accordingly be appropriate even where the underlying matter concerns an agreement with a creditor.

Tenor

Seeking a lawyer’s assistance was not unreasonable in the circumstances, so advisory assistance was warranted.

The blocked account left the applicant effectively without funds; the savings bank could not help and referred her to a lawyer. Consulting counsel was therefore reasonable from her perspective.

Extrajudicial expenses are not reimbursed.
