Tenor
Die Beklagte wird verurteilt, an den Kläger 2.781,20 € nebst Zinsen in Höhe von acht Prozentpunkten über dem jeweiligen Basiszinssatz seit dem 19.03.2014,
sowie vorgerichtliche Rechtsanwaltskosten in Höhe von 261,30 € zu zahlen.
Im Übrigen wird die Klage abgewiesen.
Die Kosten des Rechtsstreits tragen der Kläger zu 13 % und die Beklagte zu 87 %.
Das Urteil ist vorläufig vollstreckbar, für den Kläger jedoch nur gegen Sicherheitsleistung in Höhe von 110 % des jeweils zu vollstreckenden Betrages.
Von dem Kläger kann die Zwangsvollstreckung der Gegenseite durch Sicherheitsleistung in Höhe von 110 % des aus dem Urteil gegen ihn vollstreckbaren Betrages abgewendet werden, wenn nicht die Gegenseite vor der Vollstreckung Sicherheit in Höhe von 110 % des jeweils zu vollstreckenden Betrages leistet.
