Tenor

Die Beklagte wird verurteilt, an den Kläger

  1. ein weiteres Schmerzensgeld in Höhe von 1.600,00 € nebst Zinsen in Höhe von 5 Prozentpunkten über dem jeweiligen Basiszinssatz seit dem 14.08.2009

  2. weitere 36,52 € nebst Zinsen in Höhe von 5 Prozentpunkten über dem Basiszinssatz seit dem 24.09.2009

  3. vorgerichtliche Anwaltskosten in Höhe von 359,50 € nebst Zinsen in Höhe von 5 Prozentpunkten über dem Basiszinssatz seit dem 24.09.2010

zu zahlen.

Im Übrigen wird die Klage abgewiesen.

Von den Kosten des Rechtsstreits haben der Kläger 35 % und die Beklagte 65 % zu tragen.

Das Urteil ist vorläufig vollstreckbar gegen Sicherheitsleistung in Höhe von 120 % des jeweils zu vollstreckenden Betrages.

Der Streitwert wird auf 3.066,07 € festgesetzt.
