Résumé Omnilex

In this administrative-offence proceeding, the defence counsel asked on 30 June 2016 to reschedule a hearing. The Castrop-Rauxel District Court rejected the request. The court stated that requests to reschedule in cases where a driving ban is possible must be examined particularly critically. Counsel must substantiate the reasons for the request and provide credible support, including for an asserted inability to attend any court hearing throughout the six-and-a-half-week summer holiday period.

Regeste Omnilex

In administrative-offence proceedings where a driving ban is at issue, requests to reschedule a hearing are subject to particularly critical scrutiny. The defence counsel may be required to state the grounds for the request in specific terms and to substantiate them. In particular, an assertion that counsel cannot attend any court hearing throughout the entire six-and-a-half-week summer holiday period must be presented with sufficient detail and made credible. A general or unsupported assertion of holiday absence does not suffice.

Tenor

Der Terminsverlegungsantrag des Verteidigers vom 30.06.2016 wird zurückgewiesen.
