Résumé Omnilex

The Castrop-Rauxel Local Court convicted the defendant of intentionally using a mobile phone unlawfully while driving and imposed a €125 fine. The defendant had held a smartphone horizontally toward a crashed vehicle while passing it. The court considered that conduct consistent with using the phone to film or photograph the vehicle. It also held that a detailed description in the traffic offence report could be relied upon even if the witness had no present recollection. The defendant was ordered to bear the costs of the proceedings and his necessary expenses.

Regeste Omnilex

§ 23 Abs. 1a StVO; reference to an offence report and outward conduct indicating mobile-phone use while driving. A concrete and detailed description of external events in an administrative-offence report may be incorporated into the decision even where the witness no longer remembers the events. Holding a smartphone horizontally toward a crashed vehicle while driving is an act from which use of a phone function may be inferred: the apparent purpose is to film or photograph the vehicle. (Following AG Dortmund, order of 8 October 2018.)

Leitsätze

Holding a smartphone horizontally toward a crashed vehicle while driving constitutes use of a phone function, such as filming or photographing.

The outward conduct of pointing the phone toward the crashed vehicle has no plausible purpose other than filming or photographing it.

Reference to the traffic offence report remains permissible where it contains concrete and detailed descriptions of the external events.

The report's detailed account can be relied upon even if the witness no longer remembers the events.
