Tenor

Der Beklagte wird verurteilt, an den Kläger 858,80 EUR nebst 5 % Zinsen über dem jeweiligen Basiszinssatz seit dem 18.04.2002 zu zahlen. Im übrigen wird die Klage abgewiesen.

Von den Kosten de Rechtsstreits tragen der Kläger 71 % und der Beklagte 29 %.

Das Urteil ist vorläufig vollstreckbar. Die Vollstreckung darf jeweils durch

Sicherheitsleistung in Höhe von 110 % des zu vollstreckenden Betrages

abgewendet werden, wenn nicht der jeweilige Gäubiger vor der Vollstreckung in gleicher Höhe Sicherheit leistet.
