In this first-instance condominium-property proceeding, the District Court of Düsseldorf ordered the respondents to remove kitchen exhaust pipes installed along the outside wall of an annex they used as a storage unit. It also ordered them to repair the exterior plaster on that annex and on a ground-floor toilet facility. The court rejected the applicants’ further requests. The applicants were allocated nine-tenths of the court costs and the respondents one-tenth; neither side was awarded out-of-court costs. The value in dispute was fixed at DM 15,000.

b e s c h l o s s e n :

  1. Den Antragsgegnern wird aufgegeben, das entlang des von ihnen genutzten Anbaus im Hause Gwall 00, E als „Lager“ bezeichneten Teileigentums an der Außenwand verlegte Küchenablußrohre zu beseitigen.

  2. Den Antragsgegnern wird ferner aufgegeben, den Außenputz des von ihnen genutzten Anbaus im Hofgelände (frühere Kegelbahn) und den Außenputz der im Erdgeschoß liegenden Toilettenanlage auszubessern.

  3. Die weitergehenden Anträge werden zurückgewiesen.

  4. Die Antragsteller tragen 9/10, die Antragsgegner 1/10 der Gerichtskosten; außergerichtliche Kosten werden nicht erstattet.

  5. Der Geschäftswert wird auf 15.000,-- DM festgesetzt (Ziffer 1. 5.000,--, Ziffer 2. 3.000,--, Ziffer 3. 1.000,--, Ziffer 4. 1.000,--, Ziffer 5. 3.000,--, Ziffer 6. 1.000,--, Ziffer 7. 1.000,-- DM).
