The landlord sought consent to increase the monthly base rent for an apartment in Düsseldorf. The tenants had already consented to an increase of DM 202.45, from DM 605.05 to DM 807.50. After an oral hearing, the Düsseldorf District Court ordered them to consent to a further monthly increase of DM 35.73, bringing the rent to DM 843.23 from 1 January 1999. The court dismissed the remainder of the claim and apportioned costs two-thirds to the defendants jointly and severally and one-third to the plaintiff.

Tenor

hat das Amtsgericht Düsseldorf

auf die mündliche Verhandlung vom 1. Dezember 1999

durch den Richter am Amtsgericht X

für R e c h t erkannt:

Die Beklagten werden verurteilt, neben der bereits erteilten Zustimmung

zur Erhöhung der Grundmiete für die von ihnen im Hause der Klägerin in

XStraße 28 im ersten Obergeschoss rechts gemietete

Wohnung von monatlich 605,05 DM um 202,45 DM auf 807,50 DM

monatlich ab dem 01.01.1999, einer weiteren Erhöhung um 35,73 DM auf

843,23 DM monatlich ab dem 01.01.1999 zuzustimmen.

Im übrigen wird die Klage abgewiesen.

Die Kosten des Rechtsstreits tragen die Beklagten als Gesamtschuldner

zu 2/3 und die Klägerin zu 1/3.

Das Urteil ist vorläufig vollstreckbar.
