Tenor

hat das Amtsgericht Düsseldorf

auf die mündliche Verhandlung vom 2. Juni 2005

durch die Richterin am Amtsgericht X

für R e c h t erkannt:

Die Beklagte wird verurteilt, an den Kläger 1.290,26 € nebst

5 % Zinsen über dem Basiszinssatz seit dem 27. März 2002 zu zahlen.

Im Übrigen wird die Klage abgewiesen.

Von den Kosten des Rechtsstreits haben der Kläger 28 % und die Beklagte 72 % zu tragen.

Das Urteil ist vorläufig vollstreckbar, für den Kläger jedoch nur gegen Sicherheitsleistung in Höhe von 2.000,00 €. Der Kläger darf die Vollstreckung der Beklagten durch Sicherheitsleistung in Höhe von 110 % des zu vollstreckenden Betrages abwen-den, wenn nicht die Beklagte vor der Vollstreckung Sicherheit in gleicher Höhe leistet.
