für R e c h t erkannt:

Die Beklagte wird verurteilt, an die Klägerin 39,44 € nebst Zinsen in Höhe von 5 Prozentpunkten über dem jeweiligen Basiszinssatz seit dem 12. 02. 2005 zu zahlen.

Im Übrigen wird die Klage abgewiesen.

Die Kosten des Rechtsstreits werden gegeneinander aufge-hoben.

Das Urteil ist vorläufig vollstreckbar.
