Tenor

hat das Amtsgericht Düsseldorf

auf die mündliche Verhandlung vom 24. April 2005

durch den Richter am Amtsgericht X

für R e c h t erkannt:

Das Versäumnisurteil vom 13.9.2004 bleibt mit der Maßgabe aufrecht erhal-

ten, dass die Beklagte verurteilt wird, an den Kläger € 548,55 zu zahlen

nebst Zinsen in Höhe von 5 %-Punkten über dem Basiszinssatz seit dem

28.7.2004.

Die weitergehende Klage wird abgewiesen.

Von den Kosten des Rechtsstreits tragen die Beklagte die Kosten der

Säumnis und 22 % der übrigen Kosten des Rechtsstreits; der Kläger trägt

78 % der Kosten des Rechtsstreits.

Das Urteil ist vorläufig vollstreckbar.

Den Parteien wird nachgelassen, gegen Sicherheitsleistung in der Höhe der

zu vollstreckenden Forderung die Zwangsvollstreckung abzuwenden.
