Tenor

hat das Amtsgericht Düsseldorf im schriftlichen Verfahren gemäß § 128 ZPO

durch den Richter am Amtsgericht X

für R e c h t erkannt:

Die Klage wird abgewiesen.

Auf die Widerklage wird der Kläger verurteilt, an die Beklagte 5.000 €

nebst 5 % Zinsen über dem Basiszinssatz seit dem 10.4.2007 zu

zahlen.

Die Kosten des Verfahrens trägt der Kläger.

Das Urteil ist für die Beklagte gegen Sicherheitsleistung in Höhe von

110 % des beizutreibenden Betrages vorläufig vollstreckbar.

Streitwert: 5.000 €.
