für R e c h t erkannt:
Das Versäumnisurteil vom 22. September 2008 wird aufgehoben. die Be-
klagte wird verurteilt, an den Kläger 837,-- € nebst Zinsen hieraus in Höhe
von 5 Prozentpunkten über dem Basiszinssatz seit dem 20.05.2007 zu
zahlen.
Im Übrigen wird die Klage abgewiesen.
Der Kläger trägt die Kosten seiner Säumnis. Von den Gerichtskosten trägt
der Kläger 17 % und die Beklagte 83 %. Die Beklagte trägt die außergericht-
lichen Kosten des Klägers sowie ihre eigenen.
Das Urteil ist vorläufig vollstreckbar.
Die Beklagte darf die Vollstreckung des Klägers durch Sicherheitsleistung in
Höhe von 110 % des zu vollstreckenden Betrages abwenden, wenn nicht
der Kläger vor der Vollstreckung Sicherheit in gleicher Höhe leistet. Die
Partein dürfen die Sicherheiten durch Bürgschaft einer Bank oder Sparkasse
mit Sitz in der Bundesrepublik Deutschland erbringen.
