auf die mündliche Verhandlung vom 25. August 2009
durch die Richterin am Amtsgericht E
für R e c h t erkannt:
Der Beklagte wird verurteilt, an die Klägerin 2635,16 Euro nebst 5 % Zinsen
über dem Basiszinssatz seit dem 22.08.2007 zu zahlen.
Im Übrigen wird die Klage abgewiesen.
Die Kosten des Rechtsstreits werdend der Klägerin zu 11 % und dem Beklagten
zu 89 % auferlegt.
Das Urteil ist vorläufig vollstreckbar, für die Klägerin nur gegen Leistung einer
Sicherheit von 110 % des zu vollstreckenden Betrages.
Der Klägerin wird gestattet, die Vollstreckung durch Sicherheitsleistung in
Höhe von 110 % des zu vollstreckenden Betrages abzuwenden, wenn nicht
der Beklagte vor der Vollstreckung Sicherheit in gleicher Höhe leistet.
