für R e c h t erkannt:

Unter Abweisung der Klage im Übrigen wird die Beklagte verurteilt, an den Kläger 133,72 € nebst 5 % über Basiszins ab 23.11.2008 zu zahlen.

Von den Kosten des Rechtsstreits tragen der Kläger 80 % und die Beklagte 20 %.

Das Urteil ist vorläufig vollstreckbar.

Auf die Wiedergabe des Tatbestandes wird gemäß § 313 a ZPO verzichtet.
