Tenor

hat das Amtsgericht Düsseldorf

im schriftlichen Verfahren mit Schriftsatzfrist bis zum 02.03.2010

durch den Richter X

für Recht erkannt:

Die Klage wird abgewiesen.

Auf die Widerklage wird

  1. die Klägerin zu verurteilt, an den Beklagten 229,30 € nebst Zinsen in Höhe von fünf Prozentpunkten über dem jeweiligen Basiszinssatz seit dem 30.03.2009 zu bezahlen.

  2. festgestellt, dass der Klägerin aus einem Internet-System-Vertrag vom 12.08.2008, Vertragsnummer xxxxx, keine Ansprüche gegen den Beklagten für das dritte und vierte Vertragsjahr zu stehen.

  3. festgestellt, dass die Klägerin verpflichtet ist, dem Beklagten den Schaden zu ersetzen, der ihm durch die nicht ordnungsgemäße Vertragsanbahnung/Vertragsdurchführung entstanden ist bzw. entsteht.

Die Kosten des Rechtsstreits trägt die Klägerin.

Das Urteil ist vorläufig vollstreckbar. Die Klägerin kann die Vollstreckung gegen Sicherheitsleistung in Höhe von 110% des vollstreckbaren Betrages abwenden, wenn nicht der Beklagte vor der Vollstreckung Sicherheit in Höhe von 110% des jeweils zu vollstreckenden Betrages leistet.
