Die Beklagte wird verurteilt, an den Kläger € 209,25 nebst Zinsen in Höhe von 5 Prozentpunkten über dem Basiszinssatz seit dem 31.12.2009 sowie Rechtsanwaltkosten in Höhe von € 43,32 nebst Zinsten in Höhe von 5 Prozentpunkten über dem Basiszinssatz seit dem 31.12.2009 zu zahlen.
Im Übrigen wird die Klage abgewiesen.
Die Kosten des Rechtsstreits werden dem Kläger zu 60 % und der Beklagten zu 40 % auferlegt.
Dieses Urteil ist vorläufig vollstreckbar.
