Tenor

hat das Amtsgericht Düsseldorf

im vereinfachten Verfahren gemäß § 495a ZPO ohne mündliche Verhandlung am 04.10.2010

durch den Richter X

für R e c h t erkannt:

  1. Die Beklagte wird verurteilt, an die Klägerin € 362,89 nebst Zinsen hieraus in Höhe von 5 Prozentpunkten über dem jeweiligen Basiszinssatz seit dem 18.03.2010 zu zahlen. Im Übrigen wird die Klage abgewiesen.

  2. Die Beklagte trägt die Kosten des Rechtsstreits.

  3. Das Urteil ist vorläufig vollstreckbar.
