Tenor

Die Beklagte wird verurteilt, an die Klägerin 645,- € nebst Zinsen in Höhe von

5 Prozentpunkten über dem Basiszinssatz seit dem 27.08.2010 zu zahlen. Im Übrigen wird die Klage abgewiesen.

Die Klägerin trägt die durch Anrufung des unzuständigen Amtsgerichts Neuss entstandenen Mehrkosten. Die übrigen Kosten des Rechtsstreits tragen die Klägerin zu 38 % und die Beklagte zu 62 %.

Das Urteil ist vorläufig vollstreckbar. Beide Parteien können die Vollstreckung durch Sicherheitsleistung in Höhe von 120 % des für die andere Partei aufgrund des Urteils vollstreckbaren Betrages abwenden, wenn nicht die andere Partei vor der Vollstreckung Sicherheit in Höhe von 120 % des jeweils zu vollstreckenden Betrages leistet.
