In this first-instance civil judgment, the Düsseldorf Local Court ordered the defendant to pay the plaintiff €244.93, together with interest at five percentage points above the base rate from 9 February 2012. The court dismissed the remainder of the claim. It allocated 81.5% of the costs to the plaintiff and 18.5% to the defendant. The parties were also permitted to avert enforcement by the opposing party by providing security of 110% of the amount enforceable, unless the opposing party first provides security in the same amount. Tenor

Die Beklagte wird verurteilt, an die Klägerin 244,93 € nebst Zinsen in Höhe von 5%-Punkten über dem Basiszinssatz seit dem 09.02.2012 zu zahlen.

Im Übrigen wird die Klage abgewiesen.

Die Kosten des Rechtsstreits tragen die Klägerin zu 81,5% und die Beklagte zu 18,5%. Die Parteien können die Zwangsvollstreckung durch den jeweiligen Gegner gegen Sicherheit in Höhe von 110% des jeweils vollstreckbaren Betrages abwenden, wenn nicht zuvor dieser Sicherheit in gleicher Höhe leistet.
