Die Beklagten werden verurteilt, als Gesamtschuldner an den Kläger 48,60 € nebst Zinsen in Höhe von 5 Prozentpunkten über dem Basiszinssatz seit dem 24.09.2009 zu zahlen.
Die Beklagten werden verurteilen, als Gesamtschuldner den hinter dem Kläger stehenden Rechtsschutzversicherer, die B Rechtsschutz Versicherungs AG, zur Schadennummer 00000-/0000 von einer Forderung des Prozessbevollmächtigten in Höhe von 53,55 € freizustellen.
Im Übrigen wird die Klage abgewiesen.
Die Kosten des Rechtsstreits trägt der Kläger.
Das Urteil ist vorläufig vollstreckbar. Dem jeweiligen Vollstreckungsschuldner wird nachgelassen, die Vollstreckung gegen Sicherheitsleistung in Höhe von 120 % des aufgrund des Urteils vollstreckbaren Betrages abzuwenden, wenn nicht der jeweilige Vollstreckungsgläubiger vor der Vollstreckung Sicherheit in Höhe von 120 % des jeweils zu vollstreckenden Betrages leistet.
