Tenor

Es wird fest­ge­stellt, dass der Be­klag­ten kei­ner­lei An­sprü­che fi­nan­ziel­ler Art gegen die kla­gen­de Par­tei zu­ste­hen, ins­be­son­de­re nicht aus einem an­geb­lich ab­ge­schlos­se­nen Ver­trag über die Auf­nah­me der kla­gen­den Par­tei in die On­line­daten­bank der Be­klag­ten. Dies gilt ins­be­son­de­re auch für einen an­geb­lich ab­ge­schlos­se­nen Ver­trag mit an­geb­lich jähr­li­chen Zah­lungs­an­sprü­chen der Be­klag­ten über 569,06 €, für zwei Jahre also 1.138,12 €.

Die Be­klag­te wird ver­urteilt, die kla­gen­de Par­tei von den Kos­ten der In­an­spruch­nah­me des Rechts­an­walts K, D frei­zu­stel­len in Höhe von 130,50 € für des­sen au­ßer­ge­richt­li­che Tä­tig­keit im Rah­men der Durch­set­zung des ne­ga­ti­ven Fest­stel­lungs­an­spruchs gegen die Be­klag­te.

Die Kos­ten des Rechts­streits hat die Beklagte zu tra­gen.

Das Ur­teil ist vor­läu­fig voll­streck­bar.

Der Streit­wert wird auf 1.138,12 EUR fest­ge­setzt.
