I. Das Verfahren wird ausgesetzt.

II. Dem Gerichtshof der Europäischen Union wird gemäß Art. 267 Abs. 1 Buchst. b, Abs. 3 des Vertrages über die Arbeitsweise der Europäischen Union (AEUV) zur Auslegung des Gemeinschaftsrechts folgende Frage zur Vorabentscheidung vorgelegt:

Verstößt § 28 Abs.1 des Gesetzes zur Geltendmachung von Unterhaltsansprüchen im Verkehr mit ausländischen Staaten (Auslandsunterhaltsgesetz – AUG) vom 23. Mai 2011, BGBl I S. 898 gegen Art.3 Bustaben a) und b) der Verordnung (EG) Nr.4/2009 des Rates vom 18. Dezember 2008?
