Tenor
Der Beklagtenseite wird es bei Meidung eines für jeden Fall der Zuwiderhandlung hiermit angedrohten Ordnungsgeldes bis zu 250.000 EUR, ersatzweise Ordnungshaft, oder Ordnungshaft bis zu sechs Monaten, wobei die Ordnungshaft für die Beklagte zu 1) an den Geschäftsführern der Beklagten zu 1) zu vollziehen ist, untersagt, im geschäftlichen Verkehr zu Werbezwecken mit dem Kläger zur Aufnahme eines geschäftlichen Kontakts per E-Mail Kontakt aufzunehmen ohne dass eine ausdrückliche Einwilligung vorliegt.
Die Beklagten werden als Gesamtschuldner verurteilt, an den Kläger 192,90 EUR nebst Zinsen in Höhe von 5 Prozentpunkten über dem Basiszinssatz seit 27.02.2013 zu zahlen.
Die Beklagten werden als Gesamtschuldner verurteilt, den von der Klägerseite verauslagten Gerichtskostenvorschuss in Höhe von 219 EUR ab 03.01.2013 mit fünf Prozentpunkten über dem Basiszinssatz bis zum Tage des Eingangs des Kostenfestsetzungsantrages zu verzinsen.
Im Übrigen wird die Klage abgewiesen.
Die Kosten des Rechtsstreits werden den Beklagten als Gesamtschuldnern auferlegt bis auf die Kosten der Verweisung, die der Kläger trägt.
Dieses Urteil ist gegen Sicherheitsleistung in Höhe von 1.200,00 Euro vorläufig vollstreckbar.
