Tenor
Der Beklagte wird verurteilt, es bei Vermeidung eines vom Gericht für jeden Fall der Zuwiderhandlung festzusetzenden Ordnungsgeldes und für den Fall, dass dieses nicht beigetrieben werden kann, einer Ordnungshaft oder einer Ordnungshaft bis zu sechs Monaten zu unterlassen, das aus der nachfolgenden Abbildung ersichtliche Foto ohne die Zustimmung der Klägerin im Internet öffentlich zugänglich zu machen, wie geschehen auf dem Online-Marktplatz Ebay unter der eBay-Artikelnummer #######:
Der Beklagte wird weiter verurteilt, an die Klägerin einen Betrag von 90,20 Euro zu zahlen nebst Zinsen in Höhe von fünf Prozentpunkten über dem jeweiligen Basiszinssatz hieraus seit dem 12.04.2014.
Im Übrigen wird die Klage abgewiesen.
Die Kosten des Rechtsstreits tragen die Klägerseite zu 40% und die Beklagtenseite zu 60%.
Dieses Urteil ist vorläufig vollstreckbar. Die jeweilige Gegenseite kann die Vollstreckung abwenden durch Sicherheitsleistung in Höhe von 110% des jeweils zu vollstreckenden Betrages, wenn nicht die jeweils andere Seite zuvor Sicherheit in gleicher Höhe leistet.
Der Streitwert wird festgesetzt auf 200 Euro (jeweils 100 Euro für die Anträge zu 1 und 2).
Die Berufung sowie hinsichtlich der Festsetzung des Streitwertes für den Antrag zu 1 die Streitwertbeschwerde werden zugelassen.
