Tenor
Die Beklagte wird verurteilt, die Klägerin von einer Forderung ihres Prozessbevollmächtigten betreffend die vorgerichtlich angefallenen Rechtsanwaltskosten i.H.v. 413,64 EUR freizustellen.
Es wird festgestellt, dass die Beklagte verpflichtet ist, der Klägerin sämtlichen materiellen und immateriellen Schaden zu ersetzen, welcher der Klägerin aus dem Vorfall vom 25.11.2013 noch entstehen wird, soweit der Anspruch nicht auf einen Sozialversicherungsträger oder andere Dritte übergeht.
Im Übrigen wird die Klage abgewiesen.
Die Kosten des Rechtsstreits haben die Klägerin zu 24,3 % und die Beklagte zu 75,7 % zu tragen.
Das Urteil ist vorläufig vollstreckbar. Die Parteien können die Vollstreckung durch Sicherheitsleistung in Höhe von jeweils 110 % des jeweils vollstreckbaren Betrages abwenden, wenn nicht die jeweils vollstreckende Partei vor der Vollstreckung Sicherheit in Höhe von jeweils 110 % des jeweils zu vollstreckenden Betrages leistet.
