Résumé Omnilex

The claimant brought a copyright damages action over the alleged dissemination of a work through a file-sharing network. It held rights for physical media, but not internet rights. The court considered whether damages could nevertheless be calculated by the licence-analogy method and estimated under § 287 ZPO. Even assuming the method was available under § 97(2) UrhG, the claimant had to explain what portion of the overall damage was attributable to the defendants. Because it did not do so, the court found insufficient grounds for estimating damages and dismissed the action. It ordered the claimant to pay the litigation costs.

Regeste Omnilex

§ 97(2) UrhG; § 287 ZPO; calculation of copyright damages by licence analogy for file-sharing infringement. Whether a rights holder whose rights cover physical media but not internet exploitation may rely on licence analogy is doubtful. Even if the method is available in view of the unity of the damages claim under § 97(2) UrhG, the claimant must specifically demonstrate what share of the total harm is attributable to the alleged infringer. This requirement prevents recovery exceeding the overall loss. If the claimant fails to provide such allocation, the court lacks adequate factual grounds to estimate damages under § 287 ZPO; the claim must be dismissed.

The claim could not succeed because the claimant did not provide a basis for determining the defendants’ share of total harm.

Even assuming that the licence-analogy method applies under § 97(2) UrhG, the claimant had to specify the share of total damage attributable to the defendants. Without that information there were insufficient grounds for estimating damages under § 287 ZPO.

The claimant must bear the costs of the proceedings.

The claimant’s action was dismissed.
