  1. Eine Taxigenossenschaft hat Disziplinargewalt auch gegenüber solchen ihre Einrichtungen nutzenden Fahrern, die als Arbeitnehmer nicht Mitglied der Genossenschaft sind.

  2. Wird im verbandsinternen Beschwerdeweg gegen eine Disziplinarentscheidung die Entscheidungsfindung unzureichend dokumentiert, so ist die Tatsachenfeststellung durch das staatliche Gericht zu wiederholen.

  3. Es spricht eine zu widerlegende tatsächliche Vermutung dafür, dass der im Datenfunkprotokoll eingetragene Fahrer zum dort angegebenen Zeitpunkt das Taxi gefahren ist.

Tenor

Der Beklagte wird verurteilt, an die Klägerin 100,00 EUR (in Worten: einhundert Euro) nebst Zinsen in Höhe von 5 Prozentpunkten über dem jeweiligen Basiszinssatz seit dem 08.05.2015 zu zahlen.

Die Kosten des Rechtsstreits werden der beklagten Partei auferlegt.

Dieses Urteil ist vorläufig vollstreckbar.
