In this first-instance action, the plaintiff sought the names and addresses of the co-investors and trustors in Fund “X.” The Düsseldorf Local Court ordered the defendant to provide that information in a file readable by the plaintiff or, alternatively, in a printout. The defendant was ordered to bear the costs. The judgment is provisionally enforceable subject to security: EUR 5,000 for the disclosure obligation and 110% of the amount to be enforced for the remainder. Appeal was permitted.

für Recht erkannt:

Die Beklagte wird verurteilt, dem Kläger Namen und Anschriften der Mitgesellschafter/ Treugeber des Fonds „X“ in einer für den Kläger lesbaren Datei, hilfsweise durch einen Ausdruck der geforderten Informationen, mitzuteilen.

Die Beklagte trägt die Kosten des Rechtsstreits.

Das Urteil ist gegen Sicherheitsleistung in Höhe von 5.000,00 EUR hinsichtlich der Auskunft und im Übrigen gegen Sicherheitsleistung in Höhe von 110 % des jeweils zu vollstreckenden Betrages vorläufig vollstreckbar.

Die Berufung ist zugelassen.
